This training will provide law enforcement personnel with a wide variety of questions often used in DUI trials.  Participants attending the training will be engaged with an inter-active, internet presentation using multiple-choice questions.  The questions posed to the participants will be in the form of direct examination or cross examination.    Individual responses by the participants will remain anonymous.  Participants will collectively receive immediate feed-back on the accuracy of their responses.  A follow-up discussion will focus on why the participant’s responses are correct and the reasons why the responses are incorrect.  Emphasis will focus on providing correct answers to the tough questions posed by the defense.  Questions will encompass all aspects of the DUI arrest.  At the end of this eight-hour block of instruction participants will be able to:

  1. Accurately respond to predicate questions used by the prosecution.
  2. Accurately respond to questions posed by the defense.
  3. Anticipate challenges used by defense experts.
  4. Understand when it is appropriate to say, “I don’t know” to avoid providing incorrect answers.
  5. Provide correct responses based upon court decisions.

Participant Objectives

  • Correctly answer questions regarding training provided by the National Highway Traffic Safety Administration (NHTSA).
  • Correctly answer questions regarding pharmacology and physiology of alcohol/drugs on the human body.
  • Correctly answer questions regarding the three phases of the DUI process as described by NHTSA.
  • Correctly answer questions regarding the validation studies related to Standardized Field Sobriety Tests (SFSTs).
  • Correctly answer questions regarding eye examinations.
  • Correctly answer questions regarding Alternate Field Sobriety Testing (AFSTs).
  • Correctly answer questions regarding the operations of a preliminary breath test instrument.
  • Correctly answer questions related to the administrative rules for chemical testing.
  • Correctly answer questions regarding the implied consent warnings.
  • Correctly answer questions regarding evidential chemical tests.
